Assumption of Risk, Waiver of Liability & Data Protection Agreement

This Agreement is entered into between Caroline Claassen ("Coach") and the participant who accepts it at signup ("Athlete"). Participation in any training program, coaching service, consultation, strength training session, running program, online programming, or race preparation provided by the Coach is conditional upon acceptance of the terms below. By ticking the acceptance box at signup, the Athlete agrees to this Agreement in full.

1. Nature of Services

The Coach provides endurance and fitness coaching services, including running training plans, strength programming, cross-training guidance, and performance advice. The Coach is not a medical doctor, physiotherapist, dietitian, or licensed healthcare provider, and nothing provided constitutes medical advice.

2. Assumption of Risk

The Athlete understands that participation in physical training and endurance sports involves inherent risks, including but not limited to:

Training may occur outdoors, in public areas, in gyms, or without direct supervision. The Athlete voluntarily assumes full responsibility for all risks associated with participation in any activity prescribed, recommended, or supervised by the Coach.

By accepting this Agreement, the Athlete confirms that:

The Coach relies on the information provided by the Athlete when designing and adjusting programs. If the Athlete becomes severely injured or unwell during a training block, they should contact coaching@runletters.com as soon as possible.

5. Limitation of Liability

To the maximum extent permitted under Portuguese law, the Athlete releases the Coach from liability for injuries, illness, or damages resulting from participation in coaching services where such damages result from ordinary negligence.

Nothing in this Agreement excludes liability in cases of gross negligence (negligência grosseira), wilful misconduct (dolo), or where liability cannot legally be excluded.

The Athlete agrees to hold harmless and indemnify the Coach from third-party claims arising from:

The Athlete understands that performance results depend on many factors outside the Coach's control. No guarantee of performance outcomes or injury prevention is made.

8. Emergency Medical Treatment

In the event of an emergency during supervised training, the Athlete authorizes the Coach to seek emergency medical assistance if necessary. The Athlete accepts financial responsibility for any medical treatment received.

9. Subscription, Trial & Refunds

Membership begins with a 7-day free trial and then renews automatically (monthly or quarterly, depending on the plan chosen). The Athlete may cancel at any time using the link provided in their welcome email. Once the free trial has ended and a payment has been taken, paid subscription fees are non-refundable. 10. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the Portuguese Republic. Any dispute arising from this Agreement shall be submitted to the competent courts of Portugal.

11. Data Protection (GDPR)

The Coach collects and processes personal data, including health information, in order to provide safe and effective coaching services.

By accepting this Agreement, the Athlete gives explicit consent for the Coach to process health-related data for coaching purposes.

How your data is protected

Your training data and health information remain completely confidential and secure. They are never sold, and never shared with any third party, unless you have given the Coach your explicit permission to do so, or unless disclosure is strictly required by law or necessary in a medical emergency.

Your rights

The Athlete has the right to access, correct, or request deletion of their personal data, and may lodge a complaint with the Portuguese Data Protection Authority (CNPD). To exercise any of these rights, email coaching@runletters.com.
